<br />November 7.2005 <br /> <br />At a Called Meeting of the City Council on Monday, November 7, 2005, there <br />were present: <br /> <br />*Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, *Stephen E. Heretick, *Elizabeth M. Psimas, *Ray A. Smith, <br />Sr., City Manager James B. Oliver, City Attorney G. Timothy Oksman. <br /> <br />05 - 480 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, November 7, <br />2005 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 481 - The following items were discussed in Public Work Session: <br /> <br />1. SPSA - John Maher and John Hatfield <br /> <br />2. Tax Relief Recommendation I Budget Planning - Lance Wolff <br /> <br />3. Midtown Tunnel - John Rowe, Bob Baldwin and George Brisbin <br /> <br />4. New Church land Library Update <br /> <br />05 - 482 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss: <br /> <br />the performance of specific public officials, as per subsection 1; <br /> <br />the acquisition or sale of real property for a public purpose, as per <br />subsection 3; and <br /> <br />legal matters, including pending litigation, requIring the advice of legal <br />counsel, as per subsection 7. <br /> <br />The subject matter of the meeting includes the performance of City officials, the <br />possible acquisition and possible sale and development or redevelopment of certain <br />real estate properties for public purposes, and legal matters involving pending <br />litigation in federal court, as well as interpretation of federal and state laws. <br /> <br />The purpose of the meeting is to permit discussion of the performance of public <br />officials, to discuss negotiating strategy related to litigation, and to discuss negotiating <br />strategy related to the acquisition and sale of real property. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br />
