<br />October 10. 2005 <br /> <br />At a Called Meeting of the City Council on Monday, October 10, 2005, there <br />were present: <br /> <br />Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, <br />Stephen E. Heretick, Elizabeth M. Psi mas, *Ray A. Smith, Sr., City Manager James B. <br />Oliver, City Attorney G. Timothy Oksman. <br /> <br />05 - 454 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, October 10, <br />2005 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 455 - The following items were discussed in Public Work Session: <br /> <br />1. Maryview Clinic - John Stone <br /> <br />2. Residential Parking Strategy - Fred Brusso <br /> <br />3. Signs in Downtown - Bob Baldwin <br /> <br />4. Emergency Evacuation Plan - Fire Chief Newell Whitehead <br /> <br />5. Achievable Opportunities - Dr. Patton <br /> <br />6. City Council Task Discussion - John Maher <br /> <br />7. Bond Sale - Lance Wolff <br /> <br />8. TCC Update - John Rowe <br /> <br />05 - 456 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss: <br /> <br />the performance of public officials, as per subsection 1; and <br /> <br />legal matters requiring the advice of legal counsel, including but not limited <br />to pending litigation, as per subsection 7. <br /> <br />The subject matter of the meeting includes the performance of public officials, <br />discussion of litigation involving the City, and other legal matters involving <br />interpretation of the Code of Virginia and the Portsmouth City Code. <br /> <br />The purpose of the meeting is to permit confidential discussion of personnel <br />matters and strategic discussion of legal matters. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br />
