October 10. 2005 At a Called Meeting of the City Council on Monday, October 10, 2005, there were present: Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, *Ray A. Smith, Sr., City Manager James B. Oliver, City Attorney G. Timothy Oksman. 05 - 454 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, October 10, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 455 - The following items were discussed in Public Work Session: 1. Maryview Clinic - John Stone 2. Residential Parking Strategy - Fred Brusso 3. Signs in Downtown - Bob Baldwin 4. Emergency Evacuation Plan - Fire Chief Newell Whitehead 5. Achievable Opportunities - Dr. Patton 6. City Council Task Discussion - John Maher 7. Bond Sale - Lance Wolff 8. TCC Update - John Rowe 05 - 456 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss: the performance of public officials, as per subsection 1; and legal matters requiring the advice of legal counsel, including but not limited to pending litigation, as per subsection 7. The subject matter of the meeting includes the performance of public officials, discussion of litigation involving the City, and other legal matters involving interpretation of the Code of Virginia and the Portsmouth City Code. The purpose of the meeting is to permit confidential discussion of personnel matters and strategic discussion of legal matters. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
