October 11. 2005 At a Called Meeting of the City Council on Tuesday, October 11, 2005, there were present: Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, *Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Deputy City Manager L. Pettis Patton, City Attorney G. Timothy Oksman. 05 - 460 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, October 11, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 461 - The following items were discussed in Public Work Session: 1. Path of History - Nancy Perry 2. Winter Wonderland Update - Nancy Perry 3. Jamestown 2007 - Nancy Perry 4. Downtown/Midtown Development Update - John Rowe 5. Navy YMCA Update - John Rowe 6. Review of City Manager's Report Items 7. City Council Liaison Reports Councilman Whitehurst - Employee Pay Study Update Councilman Whitehurst - Portsmouth 2006 Notables Update Councilwoman Randall - Homeless Issues Update 05 - 462 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss: the performance of public officials, as per subsection 1; and legal matters, including pending litigation, requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting includes the performance of individual public officials and pending litigation. The purpose of the meeting is to permit confidential discussion of personnel matters, and to discuss litigation, legal matters, and negotiating strategy. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
