<br />September 27, 2005 <br /> <br />05 - 408(c): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO GENERAL DYNAMICS/NEXTEL <br />COMMUNICATIONS, FOR A COMMUNICATIONS TOWER AT 1940 VICTORY <br />BOULEVARD. <br /> <br />WHEREAS, General Dynamics/Nextel Communications has made <br />application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for the granting of a use permit for a communications tower at 1940 Victory <br />Boulevard; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988) for the extension of the height of an <br />existing cellular tower and the collocation of new communication equipment thereon, <br />and being more particularly described as: <br /> <br />UP-05-23 <br /> <br />Beginning at a point 1,100'::1: southeast of the southeast <br />corner of Victory Boulevard and George Washington <br />Highway; thence, in a southeasterly direction 220'::1: to a <br />point; thence, in a westerly direction 260'::1: to a point; thence, <br />in a northerly direction 110'::1: to a point the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The tower shall not exceed a total height of 150 feet. The proposed <br />lightening rod shall not exceed 6 feet in height. <br /> <br />(b) No markings or lighting shall be utilized on the tower unless required by <br />the Federal Aviation Administration (FAA). <br /> <br />(c) The tower and accompanying appurtenances shall be constructed as <br />outlined in the approved site plan. The project must be formally reviewed <br />through the Site Plan Review Process. <br />
