September 27, 2005 05 - 408(c): "RESOLUTION GRANTING A USE PERMIT TO GENERAL DYNAMICS/NEXTEL COMMUNICATIONS, FOR A COMMUNICATIONS TOWER AT 1940 VICTORY BOULEVARD. WHEREAS, General Dynamics/Nextel Communications has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit for a communications tower at 1940 Victory Boulevard; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the extension of the height of an existing cellular tower and the collocation of new communication equipment thereon, and being more particularly described as: UP-05-23 Beginning at a point 1,100'::1: southeast of the southeast corner of Victory Boulevard and George Washington Highway; thence, in a southeasterly direction 220'::1: to a point; thence, in a westerly direction 260'::1: to a point; thence, in a northerly direction 110'::1: to a point the beginning. 3. That the use permit is approved subject to the following conditions which the applicant and any successor in interest shall observe: (a) The tower shall not exceed a total height of 150 feet. The proposed lightening rod shall not exceed 6 feet in height. (b) No markings or lighting shall be utilized on the tower unless required by the Federal Aviation Administration (FAA). (c) The tower and accompanying appurtenances shall be constructed as outlined in the approved site plan. The project must be formally reviewed through the Site Plan Review Process.
