September 26. 2005 At a Called Meeting of the City Council on Monday, September 26, 2005, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Ray A. Smith, Sr., Deputy City Manager L. Pettis Patton, Senior Deputy City Attorney George M. Willson. 05 - 428 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, September 26, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 429 - The following item was discussed in Public Work Session: 1. CIP Update 05 - 430 - Motion by Mr. Moody, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia, to discuss: the award of a public contract involving the expenditure of public funds, and the discussion of the terms or scope of such contract, where discussion in an open session would adversely affect the city's bargaining position or negotiating strategy, as permitted under Subsection (A)30. The subject matter shall be a contract involving publicly-owned property in the downtown area of the City. The purpose of the meeting is to permit confidential discussion of contract negotiating strategy. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
