<br />September 13. 2005 <br /> <br />At a Called Meeting of the City Council on Tuesday, September 13, 2005, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />City Manager James B. Oliver, Jr., Senior Deputy City Attorney George M. Willson. <br /> <br />05 - 404 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the City <br />Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, September 13, <br />2005 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 405 - The following items were discussed in Public Work Session: <br /> <br />1. Commission of Architectural Review Appeal - 1 036 and 1 044 Naval Avenue <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to concur with the <br />decision of the Commission of Architectural Review for Port Norfolk and Park View to <br />deny retaining the six foot, white, vinyl, fence and was adopted by a vote 5-2 (Moody, <br />Holley). <br /> <br />2. Commission of Architectural Review Appeal - 533 Florida Avenue <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to approve the request <br />to retain vinyl windows installed at 533 Florida Avenue, and was adopted by a vote 6- <br />1 (Holley). <br /> <br />3. Downtown Development Status Briefing <br /> <br />4. Review of City Manager's Report Items <br /> <br />05 - 406 - Motion by Ms. Psi mas, and seconded by Mr. Heretick, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss: <br /> <br />appointments to boards and commissions and personnel matters, as per <br />subsection 1; <br /> <br />the possible acquisition of real property for a public purpose and the <br />possible sale of publicly owned real property, as per subsection 3; and <br /> <br />a prospective new business or industry which has not been previously <br />announced, as per subsection 5. <br /> <br />The subject matter of the meeting is appointments, personnel matters, and the <br />future use of certain real estate in the southern portion of the City. <br /> <br />The purpose of the meeting is to permit confidential discussion of <br />appointments, personnel, and negotiating strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br />
