September 13. 2005 At a Called Meeting of the City Council on Tuesday, September 13, 2005, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., City Manager James B. Oliver, Jr., Senior Deputy City Attorney George M. Willson. 05 - 404 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, September 13, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 405 - The following items were discussed in Public Work Session: 1. Commission of Architectural Review Appeal - 1 036 and 1 044 Naval Avenue Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to concur with the decision of the Commission of Architectural Review for Port Norfolk and Park View to deny retaining the six foot, white, vinyl, fence and was adopted by a vote 5-2 (Moody, Holley). 2. Commission of Architectural Review Appeal - 533 Florida Avenue Motion by Mr. Moody, and seconded by Mr. Whitehurst, to approve the request to retain vinyl windows installed at 533 Florida Avenue, and was adopted by a vote 6- 1 (Holley). 3. Downtown Development Status Briefing 4. Review of City Manager's Report Items 05 - 406 - Motion by Ms. Psi mas, and seconded by Mr. Heretick, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss: appointments to boards and commissions and personnel matters, as per subsection 1; the possible acquisition of real property for a public purpose and the possible sale of publicly owned real property, as per subsection 3; and a prospective new business or industry which has not been previously announced, as per subsection 5. The subject matter of the meeting is appointments, personnel matters, and the future use of certain real estate in the southern portion of the City. The purpose of the meeting is to permit confidential discussion of appointments, personnel, and negotiating strategy. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and
