<br />AUQust 23. 2005 <br /> <br />05 - 391 - Adoption of a resolution supporting proposed Amendment #37 to the <br />Crawford Conservation and Redevelopment Plan, which re-designates the property at <br />1103 Richmond Avenue as "to be acquired," gives the current owner the right to appear <br />at the public hearing regarding its designation, and gives the Portsmouth <br />Redevelopment and Housing Authority the power of eminent domain should it become <br />necessary to obtain clear title or to acquire the property. Vision Principle: <br />Neighborhood and Community Transformation. <br /> <br />Background: <br />. The City adopted Amendment #35 to the Crawford Plan in April 2004, which <br />added 1103 Richmond Avenue to the list of properties designated as "To Be Acquired" <br />with the Community Development Block Grant 2005 Budget. <br />. Due to incorrect records, the previous owner was notified of the public hearings <br />that lead to the adoption of Amendment #35 and, therefore, the current owner was not <br />given the opportunity to appear at the public hearing. <br />. The owner was offered more than appraised value for his property in June 2005. <br />He declined the offer. In addition, there appears to be an unreleased lien against the <br />property, from a previous owner, for more than seven times the appraised value. <br />. Proposed Amendment #37 to the Crawford Plan re-designated this property as <br />"To Be Acquired," having given the current owner the right to appear at the public <br />hearing regarding such a designation to his property. This designation also gives PRHA <br />the power of eminent domain should it become necessary to obtain clear title or to <br />acquire the property. <br /> <br />Discussion: <br />. Financial Impact: The appraised value of this property is $3,750.00. It is a <br />vacant parcel that has been designated for use as Westbury infrastructure in the City's <br />Consolidated Plan. The monies for acquisition have already been budgeted in the 2005 <br />CDBG Budget. <br /> <br />Staff Recommends: <br />Adoption of a Resolution supporting Amendment #37 to the Crawford Conservation and <br />Redevelopment Plan, which re-designates the property at 1103 Richmond Avenue as <br />"to be acquired," gives the current owner the right to appear at the public hearing <br />regarding its designation, and gives the Portsmouth Redevelopment and Housing <br />Authority the power of eminent domain should it become necessary to obtain clear title <br />or to acquire the property. Vision Principle: Neighborhood and Community <br />Transformation. <br /> <br />Next Steps Following Council Action: <br />. If Council approves the adoption of proposed Amendment #37 to the Crawford <br />Plan, PRHA will continue with the process of acquisition using the CDBG 2005 Budget <br />monies. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION APPROVING AMENDMENT NO. 37 TO THE CRAWFORD <br />CONSERVATION AND REDEVELOPMENT PLAN FOR THE CRAWFORD URBAN <br />RENEWAL PROJECT. <br /> <br />WHEREAS, this Council by resolution adopted August 1, 1967, approved a <br />Conservation and Redevelopment Plan for the Crawford Urban Renewal Project, <br />Portsmouth, Virginia (Plan) and has approved subsequent amendments thereto; and <br /> <br />WHEREAS, there has been presented to this body for consideration and <br />approval a copy of an amended Plan (Amendment 37) consisting of thirteen (13) pages <br />and one exhibit for the project area; and <br /> <br />WHEREAS, Amendment No. 37 proposes to designate an additional property as <br />"To Be Acquired"; and <br />
