II 386 AUQust 10. 2005 At a Called Meeting of the City Council on Wednesday, August 10, 2005, ther were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst Sr., 'Marlene W. Randall, Elizabeth M. Psimas, Ray A. Smith, Sr., Senior Deputy Cit Attorney George M. Willson. 05 - 361 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floo Conference Room, 801 Crawford Street, 5:00 p.m., Wednesday, August 10, 2005 fo the purpose of a Closed Meeting. By order of the Mayor." 05 - 362 - Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to go into Close Meeting pursuant to provisions of Section 2.2-3711 (A) the Code of Virginia, to discuss: legal matters requiring the advice of legal counsel, including the threat 0 litigation, as per subsection 7. The subject matter is the Garden of Prayer lawsuit. The purpose shall be to permit confidential discussion of pending litigation. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Ms. Psimas, pursuant to Section 2.2 3712(D) of the Code of Virginia, certifying that to the best of the Council Members knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meetin requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by whic the Closed Meeting was convened, were heard, discussed or considered i the meeting by the City Council.
