<br />AUQust 9. 2005 <br /> <br />At a Called Meeting of the City Council on Tuesday, August 9,2005, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />05 - 345 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the City <br />Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, August 9, 2005 <br />for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 346 - The following items were discussed in Public Work Session: <br /> <br />1. Commission of Architectural Review Appeal -1036 and 1044 Naval Avenue <br /> <br />Motion by Ms. Psi mas, and seconded by Ms. Randall, to defer motion until <br />September 13, 2005, while the City Council meets with CAR I, CAR II and D1, in an <br />already scheduled meeting, to discuss 1036 and 1044 Naval Avenue, and was <br />adopted by a vote of 6-1 (Holley). <br /> <br />2. APM Terminal Road - Barry Duval <br /> <br />3. Review of City Manager's Report Items <br /> <br />4. City Council Liaison Reports <br /> <br />- Vice Mayor Moody - Portsmouth Development Council Committee (PDCC) <br />Councilman Whitehurst - Hampton Roads Transit (HRT) Information <br /> <br />05 - 347 - Motion by Mr. Moody, and seconded by Ms. Randall, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss: <br /> <br />the acquisition or sale of real property for a public purpose, as per <br />subsection 3; <br /> <br />an unannounced prospective business or industry, as per <br />subsection 5; and <br /> <br />personnel matters, as per subsection 1. <br /> <br />The subject matter of the meeting is real property located In the southern <br />portion of the City, plus personnel matters. <br /> <br />The purpose of the meeting is to permit confidential discussion of negotiating <br />strategy and personnel matters. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br />
