AUQust 9. 2005 At a Called Meeting of the City Council on Tuesday, August 9,2005, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 05 - 345 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, August 9, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 346 - The following items were discussed in Public Work Session: 1. Commission of Architectural Review Appeal -1036 and 1044 Naval Avenue Motion by Ms. Psi mas, and seconded by Ms. Randall, to defer motion until September 13, 2005, while the City Council meets with CAR I, CAR II and D1, in an already scheduled meeting, to discuss 1036 and 1044 Naval Avenue, and was adopted by a vote of 6-1 (Holley). 2. APM Terminal Road - Barry Duval 3. Review of City Manager's Report Items 4. City Council Liaison Reports - Vice Mayor Moody - Portsmouth Development Council Committee (PDCC) Councilman Whitehurst - Hampton Roads Transit (HRT) Information 05 - 347 - Motion by Mr. Moody, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss: the acquisition or sale of real property for a public purpose, as per subsection 3; an unannounced prospective business or industry, as per subsection 5; and personnel matters, as per subsection 1. The subject matter of the meeting is real property located In the southern portion of the City, plus personnel matters. The purpose of the meeting is to permit confidential discussion of negotiating strategy and personnel matters. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
