<br />July 26. 2005 <br /> <br />UP-05-17 <br /> <br />Beginning at a point 250 feet from the south east <br />intersection of Victory Boulevard and Greenwood Drive; <br />thence in an easterly direction 191 feet to a point; thence in <br />a southerly direction 110 feet to a point; thence in a westerly <br />direction 228 feet to a point thence in a northerly direction <br />100 feet to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br />(a) The center shall care for no more than thirty children. <br /> <br />(b) The ages of the children shall be limited from 2 1/2 to 6 years of age. <br /> <br />(c) The hours of operation shall be limited to between 5:30 a.m. and 8:00 <br /> <br />p.m. <br /> <br />(d) Outside playtime shall be limited to between 8:00 a.m. and sunset. <br /> <br />(e) The applicant shall adhere to the site plan and the floor plan submitted. <br /> <br />(f) The applicant shall use the current fenced in area on the south side of <br />the property as a play yard for the daycare. This area is required to be at least 2,073 <br />square feet and be surrounded by a six-foot vinyl fence. No more than 20 children <br />shall be in the outdoor play yard at one time. <br /> <br />(g) Landscaping shall be planted on the southern, eastern, and western <br />ends of the play yard to buffer the childcare facility from adjacent properties. <br /> <br />(h) Eight on-site parking spaces shall be allocated specifically for childcare <br /> <br />uses. <br /> <br />(i) The applicant shall comply with the trash removal plan that was <br />submitted to the Department of General Services. <br /> <br />(j) The applicant shall have Fire Prevention, Health, and Building <br />Department inspections performed prior to occupancy of the childcare facility and <br />annual inspections thereafter. <br /> <br />(k) The applicant shall comply with all applicable ordinances and regulations <br />of federal, state and local governments and shall obtain and maintain all necessary <br />licensees and permits. <br /> <br />(I) All taxes and fees associated with this property shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: "Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council. <br /> <br />05-311 (e): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO DAVID BRANNOCK, T/A DAVE'S <br />COVE CAFE AND SEAFOOD MARKET FOR A RESTAURANT AT 6205A <br />PORTSMOUTH BOULEVARD. <br /> <br />WHEREAS, David Brannock, t1a Dave's Cove Cafe and Seafood Market, has <br />made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (1988) for the granting of a use permit to operate a restaurant at 6205A <br />Portsmouth Boulevard; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />
