<br />July 26. 2005 <br /> <br />WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988) for the construction of a duplex at 2 <br />Mohican Drive, and being more particularly described as: <br /> <br />UP-05-14 <br /> <br />Beginning at a point 207 feet east of the intersection <br />of Mohawk Drive and Mohican Drive; thence in an easterly <br />direction 83 feet to a point; thence in a northeast direction 63 <br />feet to a point, thence in an easterly direction 63 feet to a <br />point; thence in a northerly direction 126 feet to a point, <br />thence in a westerly direction 109 feet to a point; thence in a <br />southerly direction 130 feet to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The site shall be developed in accordance with the site plan and building <br />elevations shown in Exhibits A, B (two pages), and C, attached hereto and made a <br />part hereof. <br /> <br />(b) The applicant shall provide four off-street parking spaces. <br /> <br />(c) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />required licenses and permits. <br /> <br />(d) All taxes in connection with the subject property and the proposed use <br />shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />05-311 (c): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO QUEEN ESTER ENTERPRISES, <br />INC., T/A ALICE MAE'S SOUL FOOD CAFE FOR A RESTAURANT AT 515 <br />WASHINGTON STREET. <br />
