362 Julv 25. 2005 At a Called Meeting of the City Council on Monday, July 25, 2005, there were present: 'Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, 'Ray A. Smith, Sr., City Manager James B. Oliver, Jr., Senior Deputy City Attorney George M. Willson. 05 - 322 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6th floor, 4:00 p.m., Monday, July 25, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 323 - The following items were discussed in Public Work Session: 1. Capital Improvement Projects (CIP) 5 Year Development Update - Lance W. Wolff 2. City Council Rules 05 - 324 - Motion by Mr. Moody, and seconded by Mr. Smith, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A)(1) the Code of Virginia, to discuss or consider the following: interview prospective attorneys to be employed to defend the City in a threatened lawsuit over denial of a use permit for the Garden of Prayer Church. The subject matt~r of the meeting includes defense of a lawsuit against the City and the individual Council Members. The purpose of the meeting is to discuss legal strategy with attorneys who may be hired to represent the City. The motion was adopted by unanimous vote. Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such publiC business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
