<br />362 <br /> <br />Julv 25. 2005 <br />At a Called Meeting of the City Council on Monday, July 25, 2005, there were present: <br /> <br />'Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., <br />Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, 'Ray A. Smith, Sr., <br />City Manager James B. Oliver, Jr., Senior Deputy City Attorney George M. Willson. <br /> <br />05 - 322 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 6th floor, 4:00 p.m., Monday, July 25, 2005 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 323 - The following items were discussed in Public Work Session: <br /> <br />1. Capital Improvement Projects (CIP) 5 Year Development Update - Lance W. Wolff <br /> <br />2. City Council Rules <br /> <br />05 - 324 - Motion by Mr. Moody, and seconded by Mr. Smith, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711 (A)(1) the Code of Virginia, to discuss or consider <br />the following: <br /> <br />interview prospective attorneys to be employed to defend the City in a threatened <br />lawsuit over denial of a use permit for the Garden of Prayer Church. <br /> <br />The subject matt~r of the meeting includes defense of a lawsuit against the City and the <br />individual Council Members. <br /> <br />The purpose of the meeting is to discuss legal strategy with attorneys who may be hired <br />to represent the City. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting requirements <br />by the Virginia Freedom of Information Act, and <br /> <br />2. Only such publiC business matters as were identified in the motion by which the <br />Closed Meeting was convened, were heard, discussed or considered in the <br />meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />On motion, meeting adjourned at 7:45 p.m. <br /> <br />U"ffidb. <br /> <br /> <br />Victor H.
