July 12. 2005 At a Called Meeting of the City Council on Tuesday, July 12, 2005, there were present: *Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 05 - 307 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, July 12, 2005 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 05 - 308 - The following items were discussed in Public Work Session: 1. Flood Plain Management Plan - Robert Baldwin, Director of Planning 2. New Port UpdatelTidewater Community College/Business Park Marketing - Martha Littleton 3. Habitat for Humanity Update - Helen Summers/Dr. Patton, Deputy City Manager 4. Review of City Manager's Report Items 5. City Council Liaison Reports: - Councilwoman Psimas - Path of History Update / Todi Councilwoman Randall - Local Emergency Planning Committee Meeting / Portsmouth Community Services Board Mayor Holley - Requested a team to look at overall landscaping plan for the community of New Port Councilman Whitehurst - Pay Plan Compensation Committee Meeting Councilman Heretick - nTelos RFP Process Update Councilman Whitehurst - VA First Cities Meeting Vice Mayor Moody - VML Environmental Steering Committee Meeting Councilwoman Randall - Educational Steering Committee Meeting 05 - 309 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss: appointments to boards and commissions, as per subsection 1; and legal matters requiring the advice of legal counsel, including the threat of litigation, as per subsection 7. The subject matter of the meeting includes appointment of citizens to boards and commissions, and legal matters involving interpretation of the laws of the Commonwealth of Virginia, including the threat of litigation. The purpose of the meeting is to protect the public interest by ensuring frank and confidential discussion of possible appointments, plus legal strategy. The motion was adopted by unanimous vote. Motion by Mr. Whitehurst, and seconded by Mr. Heretick, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and
