<br />July 12. 2005 <br /> <br />At a Called Meeting of the City Council on Tuesday, July 12, 2005, there were <br />present: <br /> <br />*Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />05 - 307 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, July 12, 2005 <br />for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 308 - The following items were discussed in Public Work Session: <br /> <br />1. Flood Plain Management Plan - Robert Baldwin, Director of Planning <br /> <br />2. New Port UpdatelTidewater Community College/Business Park Marketing - Martha <br />Littleton <br /> <br />3. Habitat for Humanity Update - Helen Summers/Dr. Patton, Deputy City Manager <br /> <br />4. Review of City Manager's Report Items <br /> <br />5. City Council Liaison Reports: <br />- Councilwoman Psimas - Path of History Update / Todi <br />Councilwoman Randall - Local Emergency Planning Committee Meeting / <br />Portsmouth Community Services Board <br />Mayor Holley - Requested a team to look at overall landscaping plan for the <br />community of New Port <br />Councilman Whitehurst - Pay Plan Compensation Committee Meeting <br />Councilman Heretick - nTelos RFP Process Update <br />Councilman Whitehurst - VA First Cities Meeting <br />Vice Mayor Moody - VML Environmental Steering Committee Meeting <br />Councilwoman Randall - Educational Steering Committee Meeting <br /> <br />05 - 309 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss: <br /> <br />appointments to boards and commissions, as per subsection 1; and <br /> <br />legal matters requiring the advice of legal counsel, including the threat of <br />litigation, as per subsection 7. <br /> <br />The subject matter of the meeting includes appointment of citizens to boards <br />and commissions, and legal matters involving interpretation of the laws of the <br />Commonwealth of Virginia, including the threat of litigation. <br /> <br />The purpose of the meeting is to protect the public interest by ensuring frank <br />and confidential discussion of possible appointments, plus legal strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Heretick, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br />
