<br />June 28. 2005 <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) All truck repair and overhaul activity shall occur on the property, and no <br />truck shall remain on the property for more than thirty days. All vehicles shall have an <br />active work order. <br /> <br />(b) A maximum of 25 trucks may be stored on the property while awaiting <br />repair or overhaul. <br /> <br />(c) <br />the site. <br /> <br />No sale, resale or storage of new or used truck parts shall be allowed on <br /> <br />(d) <br />Saturday. <br /> <br />Hours of operation shall be from 10 a.m. to 7:30 p.m., Monday through <br /> <br />(e) The existing metal fence along Confederate Avenue shall be removed <br />within thirty days after approval of the use permit application. New chain link fencing <br />and landscaping shall be planted along Turnpike Road and Confederate Avenue as <br />per site plan dated March 17, 2005. <br /> <br />(f) The storage and removal of trash shall be in accordance with the Waste <br />Management Plan approved by General Services on January 19, 2005. <br /> <br />(g) The applicant shall comply with the submitted preliminary development <br />plan. The Director of Planning and Zoning or his designee must approve any <br />modifications to the plan. <br /> <br />(h) Architectural drawings showing elevations and building materials must <br />be submitted and approved by the Director of Planning and Zoning or his designee for <br />any new structure on the property. <br /> <br />(i) The applicant shall not occupy the site and operations shall not <br />commence until all improvements have been completed. <br /> <br />(j) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br />(k) All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />05-260(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO COUNTRY FAVORITES <br />RESTAURANT, INC., FOR A RESTAURANT AT 3940 GEORGE WASHINGTON <br />HIGHWAY. <br /> <br />WHEREAS, Country Favorites Restaurant, Inc., has made application <br />pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for <br />the granting of a use permit to operate a restaurant at 3940 George Washington <br />Highway; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />
