<br />At a Regular Meeting of the City Council on Tuesday, June 28, 2005,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst,
<br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr.,
<br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman.
<br />
<br />Reverend Father R. A. Nagy, Pastor, Trinity Episcopal Church opened the
<br />meeting with prayer, which was followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to approve the
<br />minutes of a Called Meeting on June 14, 2005, a Regular Meeting on June 14, 2005,
<br />and a Called Meeting on June 20, 2005, and was adopted by unanimous vote.
<br />
<br />"Y Motion by Ms. Randall, and seconded by Mr. Moody, to suspend the rules of order
<br />to take one item out of order and to consider a motion to appoint Mr. James B.
<br />Oliver, Jr. as City Manager, as part of Presentations rather than part of agenda
<br />item 05-295, Items Submitted by Council members, and was adopted by
<br />unanimous vote.
<br />
<br />"Y Motion by Mr. Moody, and seconded by Mr. Whitehurst, that Mr. James B. Oliver
<br />Jr., be appointed City Manager of the City of Portsmouth, as follows: The contract
<br />shall be through June 30, 2007, at an initial annual salary of $150,000, plus a
<br />monthly automobile allowance of $800, a monthly expense allowance of $300, and
<br />annual deferred compensation of $14,000. The Pay Plan shall be amended
<br />accordingly, effective July 1, 2005. The other terms and condition of employment
<br />shall be as per the contract recently signed by the Mayor and the Manager, which
<br />is hereby ratified and made legally binding. A copy of that contract will be filed with
<br />the City Clerk's Office. The contract incorporates Council's Vision Principles, and it
<br />also defines the proper working relationship between the Manager and the Council,
<br />all for the benefit of the public, and was adopted by the following vote:

<br />members.
<br />
<br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to change the order of
<br />business to consider item 05-293 as the first item on the agenda, and was adopted by
<br />unanimous vote.
<br />
<br />05 - 293 - Adoption of a resolution authorizing the City Manager to sign a
<br />Memorandum of Understanding (MOU) between the City, L. M. Sandler & Sons, Inc.
<br />and The Portsmouth Public Schools. Vision Principles: Robust and Prospering
<br />Economy & Neighborhood and Community Transformation.
