<br />June 14. 2005 <br /> <br />UP-05-10 <br /> <br />Beginning at the southeast corner of George <br />Washington Highway and Woodland Street, thence in a <br />southerly direction 120 feet to a point; thence in a easterly <br />direction 134 feet to a point; thence in a northerly direction <br />120 feet to a point; thence in a westerly direction 134 feet to <br />the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The applicant shall provide a minimum of 10 on-site parking spaces. <br /> <br />(b) A maximum of two (2) delivery pick-ups will occur between the hours of <br />2 a.m. and 8 a.m. <br /> <br />(c) The hours of operation shall be from 6:00 p.m. to 8:00 a.m., seven (7) <br />days a week. <br /> <br />(d) The storage/removal of trash shall be in accordance with the Waste <br />Management Plan approved by General Services on March 2, 2005 <br /> <br />(e) The applicant shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official. This shall include <br />an initial inspection prior to the opening of the business and annual inspections <br />thereafter. <br /> <br />(f) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br />(g) All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 13 - Use permit: <br /> <br />(a) Resolution granting the request of Garden of Prayer Church of God for a use <br />permit to reopen a church at 812 Washington Street. Vision Principle: <br />Neighborhood and Community transformation. <br /> <br />"Y Motion by Mr. Moody, and seconded by Mr. Whitehurst, to suspend Council <br />Rules for agenda item 05-13, that allows five (5) minutes for each speaker, to <br />allow those in opposition and support to appoint one (1) speaker each to <br />present their point of view, up to but not to exceed ten (10) minutes and also <br />suspend, for this agenda item only, our applause rule, and was adopted by a <br />vote of 6-1 (Psimas). <br /> <br />1. Cynthia Morrison, Clerk of the Circuit Court, provided follow up information <br />regarding recordation of the land record for 812 Washington Street. <br />
