<br />May 24.2005 <br /> <br />UP-05-11 <br /> <br />Starting at the northwest corner of High Street and Middle <br />Street, proceed north 56.4', then continue west 85', then <br />proceed north 27.63', then continue west 85', the proceed <br />south 15', then continue east 51.46', the continue south 69', <br />then east 175,94 feet to the starting point. <br /> <br />3. That the use permit is approved subject to the following conditions <br />which the applicant and any successor in interest shall observe: <br /> <br />(a) The use of the property shall be limited to that of a day spa and any <br />accessory uses associated with a day spa. <br /> <br />(b) The hours of operation shall be 9AM-9PM, seven days a week. <br /> <br />(c) The applicant shall obtain approval for any exterior renovations from the <br />Downtown Design Committee. <br /> <br />(d) The applicant shall provide two off street parking spaces. <br /> <br />(e) The applicant shall comply with the Waste Management Plan approved <br />by the Department of General Services. <br /> <br />(f) The applicant shall comply with all applicable ordinances and regulations <br />of federal, state and local governments and shall obtain and maintain all necessary <br />licensees and permits. <br /> <br />(g) All taxes and fees associated with this property should be paid when <br /> <br />due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, approved on first reading at the May 10, 2005 meeting, and was adopted <br />by the following vote: <br /> <br />05-222( c): <br />"ZONING AMENDMENT ORDINANCE Z-05-04." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />05 - 13 - Use permit: <br /> <br />(a) UP-04-18 <br /> <br />DOWNTOWN NEIGHBORHOOD - Garden of Prayer Church of <br />God requests a use permit to reopen a church at 812 <br />Washington Street. The property is zoned downtown D-1-P <br />public. Deferred from the May 10, 2005 City Council meeting. <br />Vision Principle: Neighborhood and Community Transformation. <br /> <br />1. Deborah T. Small, 636 South Street, spoke in opposition to this item. <br /> <br />2. Jim Nemie, 430 South Street, spoke in opposition to this item. <br /> <br />3.
