May 3. 2005 At a Called Meeting of the City Council on Tuesday, May 3, 2005, there were present: Mayor James W. Holley III, *Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, *Stephen E. Heretick, *Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 05 - 211 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6th Floor Conference Room, 801 Crawford Street, 6th floor, 4:00 p.m., Tuesday, May 3,2005 for the purpose of a Closed Meeting By order of the Mayor." 05 - 212 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A)(3) of the Code of Virginia, to discuss or consider the following: the possible acquisition of real property for a public purpose and the possible sale of publicly owned real property. The subject matter of the meeting is Charles Towne apartments, located in the Cavalier Manor area of the City. The purpose of the meeting is to permit frank and confidential discussion of negotiating position and strategy for real estate transactions. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote. Motion by Ms. Psimas, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A)(1) of the Code of Virginia, to discuss or consider the following: personnel matters. The subject matter of the meeting includes the performance of individual public officials of the City. The purpose of the meeting is to permit frank and confidential discussion of negotiating position and strategy for real estate transactions. The motion was adopted by unanimous vote. Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and
