<br />April 26. 2005 <br /> <br />(e) All exterior modifications to the building must be reviewed and approved <br />by the Downtown Design Committee. <br /> <br />(f) The applicant shall comply with the trash/garbage plan approved by the <br />Department of General Services on February 7,2005. <br /> <br />(g) All taxes and fees owed or collected in connection with the subject <br />property and operation shall be paid when due. <br /> <br />(h) The applicant and any successor in interest shall comply with all <br />applicable statutes, ordinances and regulations of federal, state and local <br />governments and shall obtain and maintain in effect all required permits. <br /> <br />(i) The applicant shall not violate any laws of the Commonwealth or <br />ordinances of the City related to peace and good order, nor suffer repeated or chronic <br />violations by any of its patrons or customers. If, the Chief of Police, in his discretion, <br />determines that there are sufficient violations of this type to comprise a significant law <br />enforcement problem, then he shall so notify the applicant in writing and shall offer to <br />meet to provide advice on how to lessen and avoid repeated offenses against peace <br />and good order. A copy of this letter shall be provided to the Director of Planning and <br />Zoning. If, within six months of the date of this letter, said Director, in his discretion, <br />determines that offences against peace and good order are continuing, then he may <br />initiate proceedings for the revocation of this permit. Provided, however, that if <br />problems of peace and good order are of such severity that the Chief of Police <br />determines that there is a significant risk to public safety or peace and good order of <br />such proportions as to create a risk of blight, then revocation proceedings may be <br />initiated by the Director without regard to the six month requirement which is otherwise <br />required. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />05 -110 - Comprehensive Plan: <br /> <br />05-110(a): <br /> <br />"A RESOLUTION ADOPTING A NEW COMPREHENSIVE PLAN FOR THE CITY OF <br />PORTSMOUTH. <br /> <br />WHEREAS, Section 15.2-2223 of the Code of Virginia, 1950, as amended, <br />requires that each locality have a comprehensive plan to guide and accomplish the <br />coordinated, adjusted and harmonious development of city land based on present and <br />probable future needs and resources, so as best to promote the health, safety, morals, <br />order, convenience, prosperity and general welfare of the locality's citizens; and <br /> <br />WHEREAS, the City's Planning Commission, after a two-year process that <br />included extensive citizen involvement, has developed and recommended for City <br />Council's consideration and adoption the Destination 2025 Comprehensive Plan; and <br /> <br />WHEREAS, the City Council has made available to the public and has <br />conducted public hearings on the recommended Plan; and <br /> <br />WHEREAS, the recommended Plan has been amended as a result of that <br />additional citizen and city council input; and <br /> <br />WHEREAS, the City Council finds that the amended Plan meets the <br />requirements of the Code of Virginia and will serve as a valuable tool and guide for the <br />future development of the City. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby adopts the Destination 2025 Comprehensive Plan as <br />recommended by the City's Planning Commission and as amended by the City <br />Council. <br />
