<br />March 22. 2005 <br /> <br />At a Called Meeting of the City Council on Tuesday, March 22, 2005, there <br />were present: <br /> <br />*Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />05 - 119 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, March 22, 2005 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 120 - The following items were discussed in Public Work Session: <br /> <br />1. Tax Exemption for Non-profit Organization - Alethia Bryce/George Willson <br /> <br />2. Renaissance Hotel Financial Report - Lance Wolff <br /> <br />3. Portside Update - Dr. Patton <br /> <br />4. Owens Creek Park - Dr. Patton <br /> <br />5. Items Submitted by City Manager <br />- American Ref-Fuel Update - John Maher <br />- Elizabeth River Project <br /> <br />05 - 121 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A)(1) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br />personnel matters, as per subsection 1; <br /> <br />the acquisition or sale of real property for a public purpose, as per <br />subsection 3; and <br /> <br />legal matters, including litigation, requiring the advice of legal counsel, as <br />per subsection 7. <br /> <br />The subject matter of the meeting includes the performance of City officials, the <br />possible acquisition and possible sale and development of certain real estate <br />properties for public purposes, and legal matters, including litigation, as well as <br />interpretation of the laws of the Commonwealth of Virginia. <br /> <br />The purpose of the meeting is to have frank and confidential discussion of <br />personnel matters, and also negotiating strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Smith, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by <br />which the Closed Meeting was convened, were heard, discussed or <br />considered in the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br />
