<br />254 <br /> <br />March 30, 2005 <br /> <br />At a Called Meeting of the City Council on Wednesday, March 30, 2005, <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />Councilwoman Marlene W. Randall opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />- City Manager's Report - <br /> <br />05 - 141 - Adoption of a resolution authorizing execution of a "Contract Amendment <br />and Release" with Harbor Center Joint Venture. <br /> <br />1. James Askew, 30 Carver Circle, spoke in opposition to this item. <br /> <br />2. Victoria Beecher, 5230 Sweetbriar Circle, spoke in opposition to this item. <br /> <br />3. Terry Danaher, 413 Dinwiddie Street, spoke in opposition to this item. <br /> <br />4. Mark Geuldig-Yatrofsky, 363 Middle Street, spoke in opposition to this item. <br /> <br />5. Fred Sanborn, 220 North Street, spoke in opposition to this item. <br /> <br />Motion by Mr. Smith, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING EXECUTION OF A "CONTRACT AMENDMENT <br />AND RELEASE" WITH HARBOR CENTER JOINT VENTURE. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager and the City Attorney are hereby authorized and directed to execute, on <br />behalf of the City, the substance of the attached "Contract Amendment and Release." <br /> <br />The City Manager is further directed to take such actions as may be reasonably <br />needed to implement said instrument, and the City Attorney is further directed to take <br />such actions as may be reasonably needed to protect the City's legal rights under said <br />instrument. <br /> <br />The City Manager and the City Attorney shall keep City Council timely informed <br />of all official actions taken pursuant to this resolution. <br /> <br />Ayes: Heretick, Psimas, Smith, Holley <br />Nays: Moody, Randall, Whitehurst <br /> <br />On motion, meeting adjourned at 7:05 p.m. <br /> <br />Minutes prepared by: <br /> <br /> <br />Anita Y.
