<br />March 8. 2005 <br /> <br />At a Called Meeting of the City Council on Tuesday, March 8, 2005, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, *Elizabeth M. Psi mas, Ray A. Smith, Sr., Interim City <br />Manager James B. Oliver, Jr., Senior Deputy City Attorney George M. Willson. <br /> <br />05 -105 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the City <br />Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, March 8, 2005 <br />for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 1 06 - The following items were discussed in Public Work Session: <br /> <br />1. Commission of Architectural Review Appeal - 549 Mount Vernon Avenue <br /> <br />Motion by Mr. Smith, and seconded by Mr. Whitehurst, to defer consideration of <br />the Commission of Architectural Review Appeal to construct a balcony and stairway at <br />the rear of 549 Mount Vernon Avenue in the Port Norfolk Historic District to the <br />meeting of April 12, 2005, and was adopted by unanimous vote. <br /> <br />2. Path of History Park - Columbia Gas Representatives <br /> <br />3. Introduction of Lynn Lochen, Director of Convention and Visitors Bureau <br /> <br />4. SPSA - American Ref-Fuel - John Maher/Councilman Whitehurst <br /> <br />5. Suffolk Fairgrounds - Portsmouth Water Transmission Mains - James Spacek <br /> <br />05 - 107 - Motion by Ms. Randall, and seconded by Mr. Smith, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br />consultation with legal counsel and briefing by staff members concerning <br />probable litigation where consultation and briefing in open session would adversely <br />affect the City's negotiating posture and consultation with legal counsel concerning a <br />legal matter requiring the provision of legal advice, as permitted under subsection <br />(A)7. <br /> <br />The subject shall be a contract between the City of Portsmouth and a private <br />business. <br /> <br />The purpose of the meeting is to permit frank and confidential discussion of <br />matter of which premature public disclosure could materially harm the interests of the <br />City and its citizens. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Ms. Randall, and seconded by Ms. Psi mas, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by <br />which the Closed Meeting was convened, were heard, discussed or <br />considered in the meeting by the City Council. <br />
