<br />February 8. 2005 <br /> <br />At a Called Meeting of the City Council on Tuesday, February 8, 2005, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, *Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />05 - 54 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, February 8, 2005 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 55 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br />employee personnel matters, as per subsection 1; and <br /> <br />the acquisition or sale of real property for a public purpose, as per <br />subsection 3. <br /> <br />The subject matter shall be personnel and real estate matters, and the purpose <br />shall be to permit frank and orderly discussion of this confidential subject matter, which <br />includes negotiating strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by a vote of 5-2. (Heretick, Randall) <br /> <br />*Councilman Ray A. Smith, Sr. arrived at 5:15 p.m. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br />subsection 3, the acquisition or sale of realty for a public purpose, or the <br />disposition of publicly held property; <br /> <br />subsection 5, prospective business expansion which has not been previously <br />announced; and <br /> <br />subsection 7, consultation with legal counsel about specific legal matters <br />requiring legal advice, as authorized by paragraph 7. <br /> <br />The subjects of the meeting are real estate, economic development, and legal <br />matters. The purpose of the meeting is to permit confidential discussion of negotiating <br />strategy. <br /> <br />The motion was adopted by a vote of 6-1. (Heretick) <br />
