<br />February 7.2005 <br /> <br />At a Called Meeting of the City Council on Monday, February 7, 2005, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., *Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />05 - 48 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Monday, February 7, 2005 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />05 - 49 - The following items were discussed in Public Work Session: <br /> <br />1. New Port Update/Financing - Tara F. Saunders <br /> <br />2. Comprehensive Youth Prevention Plan - Judy Luffman <br /> <br />3. Tattoo Establishments - G. Timothy Oksman, Dr. Demetria Lindsay, Robert Baldwin <br /> <br />4. Code Enforcement - Vehicles - Theetta Raynor, Fred R. Brusso, Jr. <br /> <br />5. Police Department Report - Chief Frank J. Kitzerow <br /> <br />6. Office of the City Manager - Prioritizing Tasks and Projects - John B. Maher <br /> <br />7. Portside - Dr. L. Pettis Patton <br /> <br />8. City Council Discussion - Funding to Civic Organizations - Lance W. Wolff <br /> <br />05 - 50 - Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br />legal matters requiring the advice of legal counsel, as per subsection 7. <br /> <br />The subject matter of the meeting includes legal matters involving contracts, and <br />also the application of federal laws to certain zoning issues. <br /> <br />The purpose of the meeting is to permit frank discussion to consider legal advice <br />related to City contracts, and also official actions of the City that are subject to certain <br />federal laws. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />Motion by Mr. Smith, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(0) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br />
