December 14, 2004 At a Called Meeting of the City Council on Tuesday, December 14, 2004, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 04 - 472 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, December 14, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 473 - The following items were discussed in Public Work Session: 1. Sheriff's Office Employees Pay Increases - James B. Oliver, Jr. 2. Financial Presentation - Lance W. Wolff 3. Community Development Planning Program (CDBG, HOME, ESG) - Dr. Patton 4. Codes Compliance Update - Phase I - Eric D. Campbell 04 - 474 - Motion by Ms. Psimas, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A)(1) of the Code of Virginia, to discuss or consider the following: appointments to boards and commissions and personnel matters, as per subsection 1; 3; and the acquisition or sale of real property for a public purpose, as per subsection legal matters requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting includes appointment of citizens to boards and commissions, personnel matters, public real estate matters in the midtown and Churchland areas of the City, and legal matters involving legal documents and interpretation of the laws of the Commonwealth of Virginia. The purpose of the meeting is to permit frank discussion of confidential matters, some of which involve negotiating tactics and strategy. The motion was adopted by unanimous vote. Motion by Ms. Psimas, and seconded by Ms. Randall, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
