<br /> At a Regular Meeting of the City Council on Tuesday, November 23, 2004,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst,
<br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr.,
<br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman.
<br />
<br /> Reverend Dr. Wilbur Kersey, Pastor, Court Street Baptist Church, opened the
<br />meeting with prayer, which was followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Heretick, and seconded by Ms. Randall, to approve the minutes of
<br />a Called Meeting on November 8, 2004, a Called Meeting on November 9, 2004,
<br />a Regular Meeting on November 9, 2004, and a Called Meeting on November 15, 2004,
<br />and was adopted by unanimous vote.

<br />04 - 451 - Presentations:
<br />
<br />· Proclamation presented to Theodora Mason for the "90th Anniversary of Portsmouth
<br />Public Libraries."
<br />
<br />· Special presentation by Commander Kevin Brenton, USS Portsmouth (SSN 707) to
<br />the City of Portsmouth.
<br />
<br />· Presentation of special lapel pins to newly appointed Board and Commission
<br />members.
<br />
<br />- Public Hearing -
<br />
<br />04 - 360 - Public hearing on a use permit application:
<br />

<br />PRENTIS PARK/BRIGHTON NEIGHBORHOOD - Community
<br />
<br />Chapel Methodist Church requests a use permit to construct and
<br />operate a new worship facility at 1656 Portsmouth Boulevard.
<br />Deferred from the September 28, 2004 City Council meeting.
<br />
<br />1. Reggie Allen, 1421 Wilcox Avenue, spoke in opposition to this item.
<br />
<br />2. Reverend Grace Lang, 1390 Watson Street, spoke in support of this item.
<br />
<br /> Motion by Mr. Whitehurst, and seconded by Mr. Smith, to defer consideration of
<br />UP-04-11 to the meeting of March 22, 2005, and was adopted by unanimous vote.

<br />- Unfinished Business -
<br />
<br />04 - 432 - Use permit:
<br />
<br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following
<br />resolution, approved on first reading at the November 9, 2004 meeting, and was
<br />adopted by the following vote:

<br />04-432(a):
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT TO VICKI PARKER TO OPERATE AN
<br />ENTERTAINMENT ESTABLISHMENT AT 455 COURT STREET.
<br />
<br /> WHEREAS, Vicki Parker has made application pursuant to Section 40-43.1 of the
<br />Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to
<br />operate an entertainment establishment at 455 Court Street, Portsmouth, Virginia;
<br />and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required
<br />to be done in connection with said application; and
