November 8, 2004 <br /> <br /> At a Called Meeting of the City Council on Monday, November 8, 2004, there <br />were present: <br /> <br />*Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, *Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />04 - 424 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, <br />November 8, 2004 for the purpose of a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04 - 425 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> economic development and real estate matters for the downtown and <br />northside areas of the City, road and highway construction matters, and also legal <br />matters. This motion for a closed meeting is made pursuant to the following <br />subsections of said statute: <br /> <br /> subsection 3, the acquisition or sale of real estate for a public purpose, or the <br />disposition of publicly held real estate; <br /> <br /> subsection 5, prospective business expansion which has not been previously <br />announced; <br /> <br /> subsection 6, investing public funds where competition or bargaining is <br />involved; and <br /> <br />subsection 7, specific legal matters requiring the advice of legal counsel. <br /> <br /> The subject matter of the meeting consists of (1) a possible new economic <br />development project or projects in the downtown area; (2) a public property transaction <br />in the northside area; (3) road and highway construction in the Churchland area; and (4) <br />several legal matters, which include contracts and possible litigation. <br /> <br /> The purpose of the meeting is to permit confidential discussion of negotiating <br />strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
