November 8, 2004 At a Called Meeting of the City Council on Monday, November 8, 2004, there were present: *Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, *Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 04 - 424 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, November 8, 2004 for the purpose of a Closed Meeting. By order of the Mayor." 04 - 425 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: economic development and real estate matters for the downtown and northside areas of the City, road and highway construction matters, and also legal matters. This motion for a closed meeting is made pursuant to the following subsections of said statute: subsection 3, the acquisition or sale of real estate for a public purpose, or the disposition of publicly held real estate; subsection 5, prospective business expansion which has not been previously announced; subsection 6, investing public funds where competition or bargaining is involved; and subsection 7, specific legal matters requiring the advice of legal counsel. The subject matter of the meeting consists of (1) a possible new economic development project or projects in the downtown area; (2) a public property transaction in the northside area; (3) road and highway construction in the Churchland area; and (4) several legal matters, which include contracts and possible litigation. The purpose of the meeting is to permit confidential discussion of negotiating strategy. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
