October 12, 2004 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, October 12, 2004, <br />there were present: <br /> <br />Vice Mayor William E. Moody, Jr., Marlene W. Randall, Stephen E. Heretick, <br />Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., <br />City Attorney G. Timothy Oksman. <br /> <br /> Reverend Rob Edwards, Cradock Baptist Church, opened the meeting with <br />prayer, which was followed by the Pledge of Allegiance to the Flag. <br /> <br />Vice Mayor Moody called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Ms. Psimas, and seconded by Ms. Randall, to approve the minutes of <br />a Called Meeting on September 27, 2004, a Called Meeting on September 28, 2004, <br />and a Regular Meeting on September 28, 2004, and was adopted by unanimous vote. <br /> <br />- Unfinished Business - <br /> <br />Consent Aqenda <br /> <br />04 - 360 - Rezoning, use permit and code amendment: <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Heretick, to adopt the following <br />ordinances and resolution, approved on first reading at the September 28, 2004 <br />meeting, and was adopted by the following vote: <br /> <br />04-360(a): <br /> <br />"ZONING AMENDMENT ORDINANCE Z-04-05." <br /> <br />04-360(c): <br /> <br />"A RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT <br />(GHUP-04-05) TO HIGH STREET PROPERTIES FOR 21 APARTMENT UNITS AT <br />619, 623, AND 627 HIGH STREET. <br /> <br /> WHEREAS, High Street Properties, pursuant to Section 40-112 of the Code of <br />the City of Portsmouth, Virginia (1988), as amended, for the approval and granting of a <br />group housing use permit for 21 apartment units to be constructed at 619, 623, and 627 <br />High Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHUP-04-05 <br /> <br />Beginning at a point 90' east of the southeast corner of the <br />intersection of Green and High Streets, then east <br />approximately 100' to a point, then 228' south to a point, <br />then 100' west to a point, then 228' north to the point of <br />beginning; <br /> <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br /> WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-116 only grants an exemption from certain requirements <br />for residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or <br />regulation; and <br /> <br /> <br />
