October 12, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, October 12, 2004, there <br />were present: <br /> <br />Vice Mayor William E. Moody, Jr., Marlene W. Randall, Stephen E. Heretick, <br />Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., <br />City Attorney G. Timothy Oksman. <br /> <br />04 - 391 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, <br />October 12, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />04 - 392 - The following items were discussed in Public Work Session: <br />1. Clean Community Commission Annual Report - Claudia Cox-Wynn <br /> <br />2. Policy Discussion - Advertising on City Assets - Eric D. Campbell/Cheran Cordell <br />3. Ntelos Pavilion - Harbor Center - Kenneth Wheeler <br /> <br />04 - 393 - Motion by Mr. Heretick, and seconded by Ms. Psimas, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> - to consult with legal counsel about specific legal matters requiring legal <br />advice, as authorized by paragraph 7, and also personnel matters, as authorized by <br />paragraph 1. <br /> <br /> The subject matter shall be legal matters involving interpretation of the City's <br />zoning ordinance and other applicable building and historic preservation codes; and <br />also personnel matters involving individual city employees, appointees, or officials. <br /> <br /> The purpose shall be to permit frank and confidential discussion of legal matters <br />that could result in litigation, and also of personnel matters. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Heretick, and seconded by Ms. Psimas, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br /> 1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br /> 2. Only such public business matters as were identified in the motion by which <br /> the Closed Meeting was convened, were heard, discussed or considered in <br /> the meeting by the City Council. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> <br />
