October 12, 2004 At a Called Meeting of the City Council on Tuesday, October 12, 2004, there were present: Vice Mayor William E. Moody, Jr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 04 - 391 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, October 12, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 392 - The following items were discussed in Public Work Session: 1. Clean Community Commission Annual Report - Claudia Cox-Wynn 2. Policy Discussion - Advertising on City Assets - Eric D. Campbell/Cheran Cordell 3. Ntelos Pavilion - Harbor Center - Kenneth Wheeler 04 - 393 - Motion by Mr. Heretick, and seconded by Ms. Psimas, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: - to consult with legal counsel about specific legal matters requiring legal advice, as authorized by paragraph 7, and also personnel matters, as authorized by paragraph 1. The subject matter shall be legal matters involving interpretation of the City's zoning ordinance and other applicable building and historic preservation codes; and also personnel matters involving individual city employees, appointees, or officials. The purpose shall be to permit frank and confidential discussion of legal matters that could result in litigation, and also of personnel matters. The motion was adopted by unanimous vote. Motion by Mr. Heretick, and seconded by Ms. Psimas, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
