29t <br /> <br /> February 22, 1994 <br /> <br /> (a) The proposed facility shall be constructed in <br />conformance with the Site Plan and the Front Elevation, <br />identified as Exhibits A and B, attached hereto and n~ade a part <br />hereof. <br /> <br />4. That the following conditions, required as part of the use <br />permit granted to the applicant on November 24, 1992, shall <br />remain in full force and effect. <br /> <br /> (a) Occupancy shall be limited to no more than twelve (12) <br />persons under the age of twelve (12) months and thirty-one (31) <br />persons over the age of twelve (12) months at any one time. <br /> <br /> (b) The applicant shall comply with the landscaping <br />requirements of Sections 40-71.2(a), (c) and (e) of the Zoning <br />Ordinance. <br /> <br /> (c) The applicant shall protect as many mature trees as <br />practicable. Only those trees within the construction footprint <br />of the building and parking lot area may be disturbed. <br /> <br /> (d) Vehicular access and egress to the site shall be <br />limited to Harris Road. <br /> <br /> (e) Ail outdoor play activities shall be conducted within a <br />fenced area and between the hours of 8:00 a.m. and 8:00 p.m. <br /> <br /> (f) Seventeen (17) parking spaces shall be provided to <br />accommodate staff and residents of the facility. <br /> <br /> (g) If the subject property becomes non-taxable at any <br />time, this use permit shall expire. <br /> <br /> (h) The applicant shall comply with all applicable codes, <br />ordinances, policies and regulations of federal, state and local <br />Governments. The applicant and/or operator shall obtain and <br />maintain all necessary licenses and permits." <br /> <br />Ayes: Clemons, Epperson, Hawks, King, Pitts, Webb <br />Nays: Griffin <br /> <br />(b) Motion by Mr. Clemons, and seconded by Mr. KinG, to concur <br />with the recommendation of the Planning Commission that <br />GHP-94-01 be approved, and the following resolution was adopted <br />and by the following vote: <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE <br />PERMIT (GHP-94-1) TO PERMIT CONSTRUCTION OF FOUR (4) TOWNHOUSE <br />UNITS LOCATED AT 5645 PARISH LANE. <br /> <br /> WHEREAS, the applicant, Herbert G. Drier, has made <br />application pursuant to Section 40-112 of the Code of the City <br />of Portsmouth, Virginia, 1988, as amended, for the approval and <br />grantinG of a group housinG use permit for the construction of <br />four (4) townhouse units located at 5645 Parish Lane, more <br />particularly described as follows: <br /> <br />GHP- 94 - 1 <br /> <br /> BeginninG on the east riGht-of-way line of Parish Lane a <br />distance of 179 feet north from its intersection with the north <br />riGht-of-way of River Shore Road; thence east 165 feet to a <br />point; thence north 93 feet to: a point; thence west 165 feet to <br />the east right-of-way line of Parish Lane; thence south alonG <br />said riGht-of-way 93 feet to the point of beginning. <br /> <br /> <br />
