September 28, 2004 At a Called Meeting of the City Council on Tuesday, September 28, 2004, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 04 - 353 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, September 28, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 354 - The following items were discussed in Public Work Session: 1. Commission of Architectural Review Appeal - 78 Park View Avenue, Unit 1 Motion by Mr. Whitehurst, and seconded by Mr. Moody, to concur with the decision of the Commission of Architectural Review for Port Norfolk and Park View to deny replacement windows, and was adopted by a vote of 6-1. (Heretick) 2. Hoffler Creek Wildlife Preserve - Randi Strutton 3. Events Management - Dr. L. Pettis Patton 4. City Council Liaison Reports - Councilman Smith - announced a Street Light Task Force meeting. - Councilman Smith and Councilwoman Randall commented on their meeting with the City Manager and School Board Liaisons. - Councilwoman Psimas - announced the Aircraft Carrier JFK will be coming to Portsmouth and indicated that the Portsmouth Military Affairs Committee would be meeting once a month. - Councilman Whitehurst - commented on his various local, state, regional and national memberships on Committees and announced attending a meeting on First Cities in Alexandria. - Vice Mayor Moody/Mayor Holley - commented on the meeting of the Mosquito Task Force. 04 - 355 - Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A)(1) of the Code of Virginia, to discuss or consider the following: The performance and appointment of specific public officers, as per subsection 1. The subject matter of the meeting is appointments to boards and commissions, and also personnel matters. The purpose of the meeting is to permit frank and confidential discussion of appointments and personnel matters. The motion was adopted by unanimous vote. Motion by Mr. Heretick, and seconded by Ms. Psimas, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and
