077 Au,qust 24, 2004 At a Called Meeting of the City Council on Tuesday, August 24, 2004, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., Deputy City Attorney George M. Willson. 04 - 309 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, August 24, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 310 - The following items were discussed in Public Work Session: 1. Commission of Architecturel Review Appeal - 34 Channing Avenue Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to concur with the decision of the Commission of Amhitectural Review for Olde Towne, Credock, and Truxton to deny the request to extend a chain link fence, and was adopted by a unanimous vote. 2. Invocation - (Court Case Briefing) - G. Timothy Oksman 3. Railroad Museum - Former Senator Willard Moody 4. Item Submitted by City Manager Clifford Street Bridge - Richard A. Hartman 04 - 311 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: appointments to boards and commissions, as per subsection 1; the sale of publicly owned property, per subsection 3; and legal matters requiring the advice of legal counsel, including the threat of litigation, as per subsection 7. The subject matter of the meeting includes appointment of citizens to boards and commissions, the possible sale of publicly owned property in the downtown area of the City; and legal matters involving interpretation of the laws of the Commonwealth of Virginia, including the threat of litigation. The purpose of the meeting is to permit frank and confidential discussion of candidates for appointment, and also matters involving negotiating strategy. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
