077 <br /> Au,qust 24, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, August 24, 2004, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., <br />Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager <br />James B. Oliver, Jr., Deputy City Attorney George M. Willson. <br /> <br />04 - 309 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City Council <br />Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, August 24, 2004 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />04 - 310 - The following items were discussed in Public Work Session: <br />1. Commission of Architecturel Review Appeal - 34 Channing Avenue <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to concur with the <br />decision of the Commission of Amhitectural Review for Olde Towne, Credock, and <br />Truxton to deny the request to extend a chain link fence, and was adopted by a <br />unanimous vote. <br /> <br />2. Invocation - (Court Case Briefing) - G. Timothy Oksman <br /> <br />3. Railroad Museum - Former Senator Willard Moody <br /> <br />4. Item Submitted by City Manager <br /> Clifford Street Bridge - Richard A. Hartman <br /> <br />04 - 311 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss <br />or consider the following: <br /> <br /> appointments to boards and commissions, as per subsection 1; <br /> <br /> the sale of publicly owned property, per subsection 3; and <br /> <br /> legal matters requiring the advice of legal counsel, including the threat of <br />litigation, as per subsection 7. <br /> <br /> The subject matter of the meeting includes appointment of citizens to boards and <br />commissions, the possible sale of publicly owned property in the downtown area of the <br />City; and legal matters involving interpretation of the laws of the Commonwealth of <br />Virginia, including the threat of litigation. <br /> <br /> The purpose of the meeting is to permit frank and confidential discussion of <br />candidates for appointment, and also matters involving negotiating strategy. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br /> 1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br /> 2. Only such public business matters as were identified in the motion by which <br /> the Closed Meeting was convened, were heard, discussed or considered in <br /> the meeting by the City Council. <br /> <br /> <br />
