July 13, 2004 051 At a Called Meeting of the City Council on Tuesday, July 13, 2004, there were present: Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. 04 - 270 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, July 13, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 271 - The following items were discussed in Public Work Session: 1. Introduction of the new Chief Financial Officer- Lance W. Wolff 2. CAR Appeal - Process Briefing - Robert A. Baldwin 3. Environmental Codes - Michael MorrisFFheetta Raynor/Robert K. Scholes 4. Events - Dr. L. Pettis Patton 04 - 271 - Motion by Mr. Whitehurst, and seconded by Ms. Randall, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: pers(~nnel matters, and also appointments to boards and commissions, as per subsection 1; and ~ legal matters requiring the advice of legal counsel, including pending litigation, as per subse~;tion 7. The subject matter of the meeting includes appointment of citizens to boards and commissions, personnel matters involving individual city employees, and legal matters and pending litigation. The purpose of the closed meeting is to permit frank discussion of personnel matters and appointments, and also to permit confidential discussion of tactics and strategy for legal matters which are in litigation and negotiation. The motion was adopted by unanimous vote. Motion by Mr. Whitehurst, and seconded by Ms. Randall, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
