July 13, 2004 051 <br /> <br /> At a Called Meeting of the City Council on Tuesday, July 13, 2004, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psimas, Ray A. Smith, Sr., <br />Interim City Manager James B. Oliver, Jr., City Attorney G. Timothy Oksman. <br /> <br />04 - 270 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, <br />July 13, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />04 - 271 - The following items were discussed in Public Work Session: <br />1. Introduction of the new Chief Financial Officer- Lance W. Wolff <br />2. CAR Appeal - Process Briefing - Robert A. Baldwin <br /> <br />3. Environmental Codes - Michael MorrisFFheetta Raynor/Robert K. Scholes <br /> <br />4. Events - Dr. L. Pettis Patton <br /> <br />04 - 271 - Motion by Mr. Whitehurst, and seconded by Ms. Randall, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> pers(~nnel matters, and also appointments to boards and commissions, as per <br />subsection 1; and ~ <br /> <br /> legal matters requiring the advice of legal counsel, including pending <br />litigation, as per subse~;tion 7. <br /> <br /> The subject matter of the meeting includes appointment of citizens to boards and <br />commissions, personnel matters involving individual city employees, and legal matters <br />and pending litigation. <br /> <br /> The purpose of the closed meeting is to permit frank discussion of personnel <br />matters and appointments, and also to permit confidential discussion of tactics and <br />strategy for legal matters which are in litigation and negotiation. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br /> 1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br /> 2. Only such public business matters as were identified in the motion by which <br /> the Closed Meeting was convened, were heard, discussed or considered in <br /> the meeting by the City Council. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> <br />
