June 22,2004 At a Called Meeting of the City Council on Tuesday, June 22, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Marlene W. Randall, Interim City Manager James B. Oliver, Jr., Deputy City Attorney George M. Willson. 04 - 246 - The following call for the meeting was read: "Please attend a Called Meeting of the City Manager's Conference Room, 801 Crawford Street, Council to be held in the City 6th floor, 5:00 p.m., Tuesday, June 22, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 247 - The following items were discussed in Public Work Session: 1. Winter Wonderland - Nancy S. Perry 2. New Churchland Library - Richard A. Hartman/Bill Hargrove 3. Public Safety Report - Chief Kitzerow 4. Summer Galaxy Program - Michael Morris/Margaret Thorne 04 - 248 - Motion by Ms. Randall, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia, to discuss or consider the following: Appointments to boards and commissions, as permitted under subsection A. 1; The disposition and use of publicly held real property, as permitted under subsection A.3; A personnel matter involving a Council appointee, as permitted under subsection A. 1; and Briefing by legal counsel and staff pertaining to a matter of actual litigation, where such briefing in open meeting would adversely affect the negotiating or litigation posture of the City, as permitted under subsection A.7. The subject matter will be appointments to City boards and commissions, the lease of City property in the downtown area of the City, a matter of actual litigation the City, and a Council appointee's employment contract. The purpose of the meeting is to protect the public interest by ensuring frank and confidential discussion of matter for which public disclosure could harm or jeopardize the public interest. The motion was adopted by unanimous vote. Motion by Mr. Griffin, and seconded by Mr. Moody, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
