<br /> At a Regular Meeting of the City Council on Tuesday, June 8, 2004,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Cameron C. Pitts, *J. Thomas
<br />William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W.
<br />City Manager C. W. McCoy, City Attorney G. Timothy Oksman.
<br />

<br />
<br /> Councilman Charles B. Whitehurst, Sr. opened the meeting with prayer, which
<br />was followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Holley spoke on the passing of former President Ronald W. Reagan and
<br />homage was paid to his memory with a moment of silence.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a
<br />Called Meeting on May 25, 2004, a Regular Meeting on May 25, 2004, a Called Meeting
<br />on June 1, 2004, and a Called Meeting of June 3, 2004, and was adopted by
<br />unanimous vote.

<br />04 - 217 - Presentation:
<br />
<br />· Presentation of the "Outstanding Group Award" to the Church Women United on
<br /> behalf of the Virginia League of Social Services Executives.

<br />- Public Hearing -
<br />
<br />04 - 218 - Public hearing on a rezoning application:
<br />
<br />(a) Z-04-02
<br />
<br />WEST NORFOLK NEIGHBORHOOD - Dan Griffin, on behalf of
<br />Western Branch Diesel, requests the rezoning of 3515 Shipwright
<br />Street from Heavy Industrial, M-2 to Light Industrial, M-1.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the
<br />recommendation of the Planning Commission that Z-04-02 be approved on first reading,
<br />and was adopted by unanimous vote.

<br />- Unfinished Business -
<br />
<br />04 - 194 - Use permit:
<br />
<br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to adopt the following
<br />resolution, approved on first reading at the May 25, 2004 meeting, and was adopted by
<br />the following vote:

<br />"A RESOLUTION GRANTING A USE PERMIT TO MICHAEL A. MABRY, T/A LARGE
<br />BROTHERS CATERING, TO OPERATE A RESTAURANT AND CATERING
<br />FACILITY AT 340 BROAD STREET.
<br />
<br /> WHEREAS, Michael A. Mabry, trading as Large Brothers Catering, has made
<br />application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia
<br />(1988) for the granting of a use permit to operate a restaurant and catering facility at
<br />340 Broad Street, Portsmouth, Virginia; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia finds that the use for
<br />which the permit is sought:
