June 8, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, June 8, 2004, there were <br />present: <br /> <br />Mayor James W. Holley III, Cameron C. Pitts, J. Thomas Berm III, <br />William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, <br />City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />04 - 214 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, (~th floor, 5:00 p.m., Tuesday, <br />June 8, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />04 - 215 - The following items were discussed in Public Work Session: <br />1. Budget Follow-up - C. W. McCoy <br /> <br />2. Codes Task Force - Chief Joseph E. Pozzo/Otis Jordan <br /> <br />3. General Assembly Report - Eric D. Campbell <br /> <br />04 - 21(~ - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-371 I(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> First, the acquisition of property for a public purpose and/or the possible sale <br />of publicly owned real property, as per subsection 3; <br /> <br /> Second, consultation with legal counsel and briefings by staff members <br />pertaining to actual litigation, as per subsection 7; and <br /> <br /> The subject matter of the meeting will be the acquisition and sale of real estate <br />where competition and bargaining will be involved, and two pending lawsuits. <br /> <br /> The purpose of the meeting is to protect the financial interests of the City and its <br />taxpayers by not disclosing confidential information and confidential strategy that may <br />be used in negotiations or in litigation. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Pitts, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br /> 1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br /> 2. Only such public business matters as were identified in the motion by which <br /> the Closed Meeting was convened, were heard, discussed or considered in <br /> the meeting by the City Council. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> <br />
