Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. WhitehurSt, Sr., <br />V~arlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />:)4 - 191 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, <br />May 25, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br /> By order of the Mayor." <br /> <br />04- 192- The following items were discussed in Public Work Session: <br /> <br />1. Budget Follow-up - Lee A. Dumbauld <br /> <br />2. Weed and Seed Program - Jennifer Adams <br /> <br />04 - 193 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or'consider the following: <br /> <br /> consult with legal counsel about specific legal matters involving pending <br />litigation, as authorized by paragraph 7. <br /> <br /> The subject matter shall be a pending lawsuit in Portsmouth Circuit Court. <br /> The purpose shall be to protect financial interest of the City and its taxpayers by <br /> permitting confidential discussion of status, tactics and strategy in litigation. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Moody, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certi~ing that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unammous vote. <br /> <br />On motion, meeting adjourned. <br /> <br />Senior Deputy City Clerk <br /> <br />APPROVED - <br /> <br />Dr. James W.
