April 27, 2004 <br /> <br /> (f) The existing entranceway at 3015 Airline Boulevard shall be utilized by <br />non-truck traffic to access either 3015 or 3029 Airline Boulevard. No truck traffic shall <br />utilize this entranceway. <br /> <br /> (g) A new entranceway shall be constructed approximately 90 feet to the west <br />of the entranceway at 3015 Airline Boulevard for the sole purpose of allowing truck <br />access to the proposed container yard at the rear of 3029 Airline Boulevard. The City <br />Engineer shall approve site access modifications during the site plan review process. <br /> <br /> (h) The chain link, barbed wire fencing located between 3015 and 3029 <br />Airline Boulevard shall be removed when the new entranceway at 3029 <br />Boulevard is created. <br /> <br />Airline <br /> <br /> (i) Group 1 landscaping shall be planted and maintained along the northern <br />and western sides of the container storage area and at the newly created entranceway <br />at 3029 Airline Boulevard. The Director of Planning shall approve the landscaping plan. <br /> <br /> (j) The applicant shall obtain all required licenses and permits and shall <br />maintain them in full force and effect. <br /> <br /> (k) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 2. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-106.1 of the Code of the City of Portsmouth, Virginia (1988), the use permit shall <br />expire for any portion of the approved project for which building permits have not been <br />issued if the applicant fails to apply for all building permits for the entire project within <br />one year of the adoption of this resolution. <br /> <br /> 3. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />04-138(b): <br /> <br />"A RESOLUTION GRANTING APPROVAL OF A USE PERMIT FOR AN EATING <br />ESTABLISHMENT AT 429 AND 433 HIGH STREET. <br /> <br /> WHEREAS, Nancy Alberts has made application pursuant to Section 40-112 of <br />the Code of the City of Portsmouth, Virginia (1988), as amended, for approval of a use <br />permit to operate an eating establishment at 429 and 433 High Street; and <br /> <br />WHEREAS, the subject property is more particularly described as follows: <br /> <br />UP-04-04 <br /> <br />Beginning at the southeast corner of High and Dinwiddie <br />Streets; thence, in an easterly direction 40'+ to a point; <br />thence, in a southerly direction 57'+ to a point; thence, in a <br />westerly direction 40'+ to a point; thence, in a northerly <br />direction 57'+ to the point of beginning. <br /> <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br /> WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia finds that the use for <br />which the permit hereinafter-described is sought: <br /> <br /> <br />
