April 27, 2004 (f) The existing entranceway at 3015 Airline Boulevard shall be utilized by non-truck traffic to access either 3015 or 3029 Airline Boulevard. No truck traffic shall utilize this entranceway. (g) A new entranceway shall be constructed approximately 90 feet to the west of the entranceway at 3015 Airline Boulevard for the sole purpose of allowing truck access to the proposed container yard at the rear of 3029 Airline Boulevard. The City Engineer shall approve site access modifications during the site plan review process. (h) The chain link, barbed wire fencing located between 3015 and 3029 Airline Boulevard shall be removed when the new entranceway at 3029 Boulevard is created. Airline (i) Group 1 landscaping shall be planted and maintained along the northern and western sides of the container storage area and at the newly created entranceway at 3029 Airline Boulevard. The Director of Planning shall approve the landscaping plan. (j) The applicant shall obtain all required licenses and permits and shall maintain them in full force and effect. (k) All taxes and fees in connection with the subject property and operation shall be paid when due. 2. EXPIRATION OF PERMIT: Unless extended as provided under Section 40-106.1 of the Code of the City of Portsmouth, Virginia (1988), the use permit shall expire for any portion of the approved project for which building permits have not been issued if the applicant fails to apply for all building permits for the entire project within one year of the adoption of this resolution. 3. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the permit by the City Council." 04-138(b): "A RESOLUTION GRANTING APPROVAL OF A USE PERMIT FOR AN EATING ESTABLISHMENT AT 429 AND 433 HIGH STREET. WHEREAS, Nancy Alberts has made application pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for approval of a use permit to operate an eating establishment at 429 and 433 High Street; and WHEREAS, the subject property is more particularly described as follows: UP-04-04 Beginning at the southeast corner of High and Dinwiddie Streets; thence, in an easterly direction 40'+ to a point; thence, in a southerly direction 57'+ to a point; thence, in a westerly direction 40'+ to a point; thence, in a northerly direction 57'+ to the point of beginning. and WHEREAS, the Planning Commission has reviewed such application and site plan submitted therewith and has recommended conditional approval of said application; and WHEREAS, the applicant is aware that building permits and any other required permit will be issued only upon compliance with the ordinances, laws or regulations applicable thereto; and WHEREAS, the Council of the City of Portsmouth, Virginia finds that the use for which the permit hereinafter-described is sought:
