April 26, 2004 5 <br />At a Called Meeting of the City Council on Monday, April 26, 2004, there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Berm ill, William E. Moody, Jr., Charles B. Whitehurst, Sr., <br />City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />04 - 152 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City Manager's <br />Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, April 26, 2004 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04 - 153 - Motion by Mr. Griffin, and seconded by Mr. Moody, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the <br />following: <br /> <br />3; and <br /> <br />personnel matters, as per subsection 1; <br /> <br />the acquisitiOn or sale of real property for a public purpose, as per subsection <br /> <br /> legal matters, including pending litigation, requiring the advice of legal <br />counsel, as per subsection 7. <br /> <br /> The subject matter of the meeting includes the performance of City officials, the possible <br />acquisition and possible sale and development of certain real estate properties for public <br />purposes, and legal matters involving pending litigation in federal court and state court, as well <br />as interpretation of the laws of the Commonwealth of Virginia. <br /> <br /> The purpose of the meeting is to permit frank discussion of confidential matters, and to <br />protect the financial interests of the City and its taxpayers, since the principal matters to be <br />discussed involve negotiations and strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Vrginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting reqUirements by <br /> the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which the <br />Closed Meeting was c~nvened, were heard, discussed or considered in the meeting <br />by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> On motion, the meeting adjourned at 6:30 p.m. <br />Senior Deputy City Clerk <br /> <br />APPROVED - <br /> <br />Dr. James W.
