April 26, 2004 5 At a Called Meeting of the City Council on Monday, April 26, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Berm ill, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager C. W. McCoy, City Attorney G. Timothy Oksman. 04 - 152 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Monday, April 26, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 153 - Motion by Mr. Griffin, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: 3; and personnel matters, as per subsection 1; the acquisitiOn or sale of real property for a public purpose, as per subsection legal matters, including pending litigation, requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting includes the performance of City officials, the possible acquisition and possible sale and development of certain real estate properties for public purposes, and legal matters involving pending litigation in federal court and state court, as well as interpretation of the laws of the Commonwealth of Virginia. The purpose of the meeting is to permit frank discussion of confidential matters, and to protect the financial interests of the City and its taxpayers, since the principal matters to be discussed involve negotiations and strategy. The motion was adopted by unanimous vote. Motion by Mr. Griffin, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Vrginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting reqUirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was c~nvened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote. On motion, the meeting adjourned at 6:30 p.m. Senior Deputy City Clerk APPROVED - Dr. James W. Holley III Mayor City Clerk '~.~ Councilwoman Marlene W.
