590 April 20, 2004 <br /> <br />At a Called Meeting of the City Council on Tuesday, April 20, 2004, there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas <br />Berm III, William E. Moody, Jr., Charles B. WhitehursL Sr.,. Marlene W. Randall, City Manager <br />C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />04 - 149 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City Manager's <br />Conference Room, 801 Crawford Street, 6th floor~ 5:00 p.m., Tuesday, April 20, 2004 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor? <br /> <br />04 - 150 - The following item was discussed in Public Work Session: <br /> <br />1. Proposec Annual Operating Budget Follow-up <br /> <br />04 - 151 - Motion by Mr. Griffin, and seconded by Mr. Moody, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-371 I(A) of the Code of Virginia. to discuss or consider the <br />following: <br /> <br /> First the acquisition of property for a public purpose and the possible sale of <br />publicly owned real property, as per subsection 3; <br /> <br /> Second, consultation with legal counsel and briefings by staff members <br />pertaining [o actual or probable litigation, as per subsection 7; and <br /> <br /> Third, other specific legal matters requiring the advice of legal counsel, as per <br />subsection 7. <br /> <br /> The subject matter of the meeting wil be the acquisition and sale of real estate where <br />competition and bargaining will be involved, a pending lawsuit, a threatened lawsuit, and also <br />other legal matters involving legal documents and interpretation of the laws of [he <br />Commonwealth of Virginia, requiring the advice of legal counsel. <br /> <br /> The purpose of the meeting is to protect the financial interests of the City and its <br />taxpayers by not disclosing confidential information and confidential strategy that may be used <br />in negotiations or in litigation. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Pitts, pursuant to Section 2.2-3712(D) of <br />the Code of Virginia, certifying that to the best of the Council Members' knowledge during the <br />immediately preceding Closed Meeting of the City Council: <br /> <br />'~. Only public business matters lawfully exempted from open meeting requirements by <br /> the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which the <br />Closed Meeting was convened, were heard, discussed or considered in the meeting <br />by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> On motion, meeting adjourned at 8:06 p.m. <br /> <br /> / <br />Min tes re ar, <br /> <br />Victor H.
