April 13, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, April 13, 2004, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />04 - 134 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, April <br />13, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04 - 135 - The following items were discussed in Public Work Session: <br /> <br />Introductions of Key Staff Persons - Barbara Willis - Community Health Center - Jennifer Adams - Weed and Seed Coordinator <br /> - Margaret Thorne - Recreation Manager <br /> - Rachael L. Cox- Assistant Engineer <br /> <br />2. Sexual Assault Nurse Examiner Program - Bon Secours Maryview - Mr. Dominick <br /> Calgi <br /> <br />3. Budget Follow-up - Lee A. Dumbauld <br /> <br />4. Consolidated Action Plan - Dr. L. Pettis Patton <br /> <br />04 - 136 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> briefing by legal counsel and staff on legal matters, including threatened and <br />actual litigation, as per subsection 7. <br /> <br /> the acquisition of real property for a public purpose, or the disposition of <br />publicly held property, where competition or bargaining is involved, as per subsection 3; <br />and <br /> <br /> prospective business expansion which has not been previously announced, <br />as per subsection 5. <br /> <br /> The subject matter of the meeting entails interpretation of the laws of the <br />Commonwealth of Virginia, real estate transactions, and economic development. <br /> <br /> The purpose of the meeting is to permit frank and confidential discussion of <br />matters for which premature public disclosure could disclose strategy or otherwise harm <br />the financial interests of the City and its taxpayers. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br /> <br />
