March 24, 2004 <br /> <br /> At a Called Meeting of the City Council on Wednesday, March 24, 2004, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, <br />William E. Moody, Jr., Charles B. Whitehurst, Sr., <br />City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />Sr., Cameron C. Pitts, <br />Marlene W. Randall, <br /> <br />04 - 117 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Wednesday, <br />March 24, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04- 118- The following item was discussed in Public Work Session: <br /> <br />1. Harley Davidson <br /> <br />04 - 119 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br />First, the possible sale of publicly owned real property, as per subsection 3; <br /> <br /> Second, consultation with legal counsel and briefings by staff members or <br />consultants pertaining to actual or probable litigation, as per subsection 7; and <br /> <br /> Third, other specific legal matters requiring the advice of legal counsel, as per <br />subsection 7. <br /> <br /> The subject matter of the meeting will be the sale of real estate where <br />competition and bargaining will be involved, a threatened lawsuit, and also other legal <br />matters involving legal documents and interpretation of the laws of the Commonwealth <br />of Virginia, requiring the advice of legal counsel. <br /> <br /> The purpose of the meeting is to protect the financial interests of the City and its <br />taxpayers by not disclosing confidential information and strategy that may be used in <br />negotiations or in litigation. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Moody, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
