March 24, 2004 At a Called Meeting of the City Council on Wednesday, March 24, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager C. W. McCoy, City Attorney G. Timothy Oksman. Sr., Cameron C. Pitts, Marlene W. Randall, 04 - 117 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Wednesday, March 24, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04- 118- The following item was discussed in Public Work Session: 1. Harley Davidson 04 - 119 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: First, the possible sale of publicly owned real property, as per subsection 3; Second, consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation, as per subsection 7; and Third, other specific legal matters requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting will be the sale of real estate where competition and bargaining will be involved, a threatened lawsuit, and also other legal matters involving legal documents and interpretation of the laws of the Commonwealth of Virginia, requiring the advice of legal counsel. The purpose of the meeting is to protect the financial interests of the City and its taxpayers by not disclosing confidential information and strategy that may be used in negotiations or in litigation. The motion was adopted by unanimous vote. Motion by Mr. Griffin, and seconded by Mr. Moody, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
