March 23, 2004 At a Called Meeting of the City Council on Tuesday, March 23, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. 04 - 106 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, March 23, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 107 - The following item was discussed in Public Work Session: 1. Signs for Support - Thom Perry 04 - 108 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: First the acquisition or sale of real property for a public purpose, as per subsection 3; and Second, legal matters requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting the acquisition or sale of real estate where competition and bargaining will be involved, involving various properties within the City; and also legal matters involving legal documents and interpretation of the laws of the Commonwealth of Virginia, requiring the advice of legal counsel. The purpose of the meeting is to protect the financial interests of the City and its taxpayers by not disclosing confidential negotiating information and strategy. The motion was adopted by unanimous vote. Motion by Mr. Whitehurst, and seconded by Mr. Moody, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Pitts, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: consult with legal counsel and staff about actual or threatened litigation, as authorized by paragraph 7. The subject matter shall be legal matters in the nature of legal claims and lawsuits involving the City and a contractor.
