March 23, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, March 23, 2004, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., <br />Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />04 - 106 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, <br />March 23, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04 - 107 - The following item was discussed in Public Work Session: <br /> <br />1. Signs for Support - Thom Perry <br /> <br />04 - 108 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> First the acquisition or sale of real property for a public purpose, as per <br />subsection 3; and <br /> <br /> Second, legal matters requiring the advice of legal counsel, as per <br />subsection 7. <br /> <br /> The subject matter of the meeting the acquisition or sale of real estate where <br />competition and bargaining will be involved, involving various properties within the City; <br />and also legal matters involving legal documents and interpretation of the laws of the <br />Commonwealth of Virginia, requiring the advice of legal counsel. <br /> <br /> The purpose of the meeting is to protect the financial interests of the City and its <br />taxpayers by not disclosing confidential negotiating information and strategy. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Pitts, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or <br />consider the following: <br /> <br /> consult with legal counsel and staff about actual or threatened litigation, as <br />authorized by paragraph 7. <br /> <br /> The subject matter shall be legal matters in the nature of legal claims and <br />lawsuits involving the City and a contractor. <br /> <br /> <br />
