March 9, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, March 9, 2004, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager <br />C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />04 - 89 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City Council <br />Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, March 9, 2004 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04 - 90 - The following items were discussed in Public Work Session: <br /> <br />1. Commission of Architectural Review Appeal- 1048 Naval Avenue <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Benn, to concur with the decision of <br />the Commission of Architectural Review for Port Norfolk and Park View to deny <br />removing a slate roof and installing architectural grade shingles, and was adopted by <br />unanimous vote. *Note: The applicant did not appear for the appeal. He indicated <br />earlier in the day to the City Clerk that he intended to withdraw his appeal. No formal <br />withdrawal was received. <br /> <br />2. City Assessor's Annual Report - William E. Froehlich <br /> <br />3. Southeastern Public Service Authority (SPSA) Briefing - John Hadfield, Executive <br /> Director <br /> <br />4. Retirement Systems' Funding - Lee A. Dumbauld <br /> <br />04 - 91 - Motion by Mr. Pitts, and seconded by Ms. Randall, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or <br />consider the following: <br /> <br /> appointments to boards and commissions, per subsection 1, and legal <br />matters requiring the advice of legal counsel, as per subsection 7. <br /> <br /> The subject matter of the meeting is the appointments to boards and <br />commissions of the City, and also legal matters related to pending or threatened <br />litigation involving the City. <br /> <br /> The purpose of the meeting is to protect the public interest by ensuring frank and <br />confidential discussion of matters for which public disclosure could harm or jeopardize <br />the public interest. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
