February 24, 2004 (d) Outdoor play hours shall be limited to the hours between 8:00 a.m. and dusk, Monday through Friday. (e) height. All required licenses and permits shall be obtained and maintained in effect. (I) All taxes and fees owed or collected in connection with the subject property and operations shall be paid when due. (m) The operation of the child care center shall be limited to the first floor of the educational wing of the church. 3. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 04-58(b): "A RESOLUTION GRANTING A USE PERMIT TO TIM AND SHANNON WOODLAND TO OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 300 HIGH STREET. WHEREAS, Tim and Shannon Woodland have made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate an entertainment establishment at 300 High Street, Portsmouth, Virginia; and WHEREAS, the applicants and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions; and WHEREAS, the Council of the City of Portsmouth, Virginia finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses;
