January 27, 2004 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, January 27, 2004, <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br /> Councilman Charles B. Whitehurst, Sr. opened the meeting with prayer, which <br />was followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to approve the minutes <br />of a Called Meeting on January 13, 2004, a Regular Meeting on January 13, 2004, and <br />a Called Meeting January 20, 2004, and was adopted by a vote of 6-1 (Pitts). <br /> <br />04 - 33 - Presentation: <br /> <br />· Proclamation presented to Jeffery Herring, President of the African American <br /> Historical Society for "African American History Month." <br /> <br />- Public Hearing - <br /> <br />04 - 08 - Public hearing on a use permit application: <br /> <br />(a) UP-03-28 <br /> <br />DOWNTOWN NEIGHBORHOOD - Thomas Sherrill requests a use <br />permit to operate a restaurant at 341 High Street. Deferred from <br />the January 13, 2004 City Council meeting. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to accept the applicant's <br />letter of withdrawal of UP-03-28, and was adopted by unanimous vote. <br /> <br />04 - 34 - Public hearing on a use permit application: <br /> <br />(b) UP-03-22 <br /> <br />PRENTIS PLACE NEIGHBORHOOD Rocket Sonar, Inc., <br />requests a use permit to operate a trucking company at 915 Duke <br />Street. <br /> <br />Richard L. Cleveland, 1731 Maple Avenue, spoke in opposition to this item. <br /> <br />Yvonne Cleveland, 1731 Maple Avenue, spoke in opposition to this item. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-03-22 be denied on first and final <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />Consent Aqenda <br /> <br />- Unfinished Business - <br /> <br />04 - 08 - Use permit, rezoning and code amendment: <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, to adopt the following <br />resolution and ordinances, approved on first reading at the January 13, 2004 meeting, <br />and was adopted by the following vote: <br /> <br /> <br />
