January 27, 2004 At a Called Meeting of the City Council on Tuesday, January 27, 2004, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. 04 - 30 - The following call for the meeting was read: "Please attend a Called Meeting of the City Manager's Conference Room, 801 Crawford Street, Council to be held in the City 6th floor, 5:00 p.m., Tuesday, January 27, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 31 - The following items were discussed in Public Work Session: 1. Commission of Architectural Review Appeal- 1010 Naval Avenue Motion by Mr. Whitehurst, and seconded by Ms. Randall, to accept the applicant's withdrawal, and was adopted by a unanimous vote. 2. Financial Report - PFM Advisors - Joanne Carter/Lee A. Dumbauld 3. Yorktown Cruises - Thomas Ainsworth 4. Hoffler Creek Wildlife Preserve - Randi Strutton/David Whitehurst 5. Legislative Proposals Update - Eric D. Campbell 04 - 32 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: legal matters requiring the advice of legal counsel and staff, including the threat of litigation, as per subsection 7. The subject matter of the meeting is litigation to which the City will be a party. The purpose of the meeting is to protect the public interest in having frank discussion of confidential legal strategy. The motion was adopted by unanimous vote. Motion by Mr. Whitehurst, and seconded by Ms. Randall, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
