January 27, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, January 27, 2004, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />04 - 30 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City <br />Manager's Conference Room, 801 Crawford Street, <br /> <br />Council to be held in the City <br /> 6th floor, 5:00 p.m., Tuesday, <br /> <br />January 27, 2004 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />04 - 31 - The following items were discussed in Public Work Session: <br />1. Commission of Architectural Review Appeal- 1010 Naval Avenue <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, to accept the <br />applicant's withdrawal, and was adopted by a unanimous vote. <br /> <br />2. Financial Report - PFM Advisors - Joanne Carter/Lee A. Dumbauld <br /> <br />3. Yorktown Cruises - Thomas Ainsworth <br /> <br />4. Hoffler Creek Wildlife Preserve - Randi Strutton/David Whitehurst <br /> <br />5. Legislative Proposals Update - Eric D. Campbell <br /> <br />04 - 32 - Motion by Mr. Whitehurst, and seconded by Mr. Moody, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> legal matters requiring the advice of legal counsel and staff, including the <br />threat of litigation, as per subsection 7. <br /> <br /> The subject matter of the meeting is litigation to which the City will be a party. <br /> <br /> The purpose of the meeting is to protect the public interest in having frank <br />discussion of confidential legal strategy. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br /> 1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br /> 2. Only such public business matters as were identified in the motion by which <br /> the Closed Meeting was convened, were heard, discussed or considered in <br /> the meeting by the City Council. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> <br />
