January 13, 2004 <br /> <br /> At a Called Meeting of the City Council on Tuesday, January 13, 2004, there <br />were present: <br /> <br />*Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., *Marlene W. <br />Randall, City Manager C. W. McCoy, Deputy City Attorney George M. Willson. <br /> <br />04 - 04 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City Council <br />Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, January 13, 2004 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />04 - 05 - The following items were discussed in Public Work Session: <br /> <br />1. Commission of Architectural Review Appeal - 516 Broad Street <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to concur with the decision <br />of the Commission of Architectural Review for Port Norfolk and Park View to deny <br />retaining a white vinyl picket fence, and was adopted by a unanimous vote. <br /> <br />2. Community Planning and Development Program (CPDP) - Dr. L. Pettis Patton <br /> <br />04 - 06 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> consultation with legal counsel and briefing by staff members pertaining to <br />probable litigation where such consultation or briefing in open meeting would adversely <br />affect the litigating posture of the City, as permitted under subsection 7. <br /> <br /> The subject matter shall be a contract between the City of Portsmouth and <br />another local government. <br /> <br /> The purpose of the meeting is to permit frank and confidential discussion of <br />matters for which premature disclosure could materially harm the interests of the city <br />and its citizens. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
