January 13, 2004 At a Called Meeting of the City Council on Tuesday, January 13, 2004, there were present: *Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., *Marlene W. Randall, City Manager C. W. McCoy, Deputy City Attorney George M. Willson. 04 - 04 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, January 13, 2004 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 04 - 05 - The following items were discussed in Public Work Session: 1. Commission of Architectural Review Appeal - 516 Broad Street Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to concur with the decision of the Commission of Architectural Review for Port Norfolk and Park View to deny retaining a white vinyl picket fence, and was adopted by a unanimous vote. 2. Community Planning and Development Program (CPDP) - Dr. L. Pettis Patton 04 - 06 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: consultation with legal counsel and briefing by staff members pertaining to probable litigation where such consultation or briefing in open meeting would adversely affect the litigating posture of the City, as permitted under subsection 7. The subject matter shall be a contract between the City of Portsmouth and another local government. The purpose of the meeting is to permit frank and confidential discussion of matters for which premature disclosure could materially harm the interests of the city and its citizens. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
