December 16, 2003 <br /> <br /> (e) Individual containers may not remain on site for more than five <br />consecutive days. <br /> <br />(f) Site must be screened with a Landscaping Group 1 screen. <br /> <br />(g) The applicant shall provide a minimum of 18 off-street parking spaces. <br /> <br /> (h) All taxes and fees owed or collected in connection with the subject <br />property and operation shall be paid when due. <br /> <br /> (i) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local governments <br />and shall obtain and maintain all necessary licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />03-422(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR A CHILDCARE FACILITY AT 300 <br />CHEROKEE ROAD. <br /> <br /> WHEREAS, Lonnie L. Parker, by his attorney, James T. Martin, Esq., has <br />made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (1988) for the granting of a use permit to operate a childcare facility at 300 <br />Cherokee Road; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the City Council has considered the Planning Commission's <br />recommendation of denial of the use permit and the City Manager's recommendation of <br />approval of the use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988) for the operation of a childcare facility at <br />300 Cherokee Road, and being more particularly described as: <br /> <br /> <br />
