November 10, 2003 <br /> <br /> At a Called Meeting of the City Council on Monday, November 10, 2003, there <br />were present: <br /> <br />Mayor James W. Holley III, *Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />*William E. Moody, Jr., Charles B. Whitehurst, Sr. Marlene W. Randall, City Manager <br />C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />03 - 400 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to <br />Manager's Conference Room, 801 Crawford Street, 6th floor, <br />November 10, 2003 for the purpose of a Closed Meeting. <br /> <br />be held in the City <br />5:00 p.m., Monday, <br /> <br /> In addition, you may be asked to vote on a resolution authorizing the City <br />Manager to negotiate and enter into a contract to replace the roof structure for Harbor <br />Center. <br /> <br />By order of the Mayor." <br /> <br />03 - 401 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to consult <br />with legal counsel about specific legal matters requiring legal advice, as authorized by <br />paragraph 7. <br /> <br />The subject matter shall be legal matters involving interpretation of the laws of <br />the Commonwealth of Virginia, including probable litigation. <br /> <br /> The purpose shall be to protect the public interest in having frank and orderly <br />consideration of confidential subject matter, for which public discussion could harm the <br />interests of the City and its taxpayers. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />03 - 402 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss: <br /> <br />and <br /> <br />- the acquisition or sale of real property for a public purpose, as per subsection 3; <br /> <br />- legal matters requiring advice of legal counsel, as per subsection 7. <br /> <br />The subject matter of the meeting includes the possible acquisition and possible sale <br />and development of certain real estate properties for public purposes, and legal matters <br />involving legal documents and interpretation of the laws of the Commonwealth of <br />Virginia, and possible litigation. <br /> <br /> The purpose of the meeting is to protect and permit frank and confidential <br />discussion of matters for which public disclosure could harm the financial interests of <br />the City and its taxpayers. <br /> <br /> <br />
