November 10, 2003 At a Called Meeting of the City Council on Monday, November 10, 2003, there were present: Mayor James W. Holley III, *Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, *William E. Moody, Jr., Charles B. Whitehurst, Sr. Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. 03 - 400 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to Manager's Conference Room, 801 Crawford Street, 6th floor, November 10, 2003 for the purpose of a Closed Meeting. be held in the City 5:00 p.m., Monday, In addition, you may be asked to vote on a resolution authorizing the City Manager to negotiate and enter into a contract to replace the roof structure for Harbor Center. By order of the Mayor." 03 - 401 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to consult with legal counsel about specific legal matters requiring legal advice, as authorized by paragraph 7. The subject matter shall be legal matters involving interpretation of the laws of the Commonwealth of Virginia, including probable litigation. The purpose shall be to protect the public interest in having frank and orderly consideration of confidential subject matter, for which public discussion could harm the interests of the City and its taxpayers. The motion was adopted by unanimous vote. Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote. 03 - 402 - Motion by Ms. Randall, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss: and - the acquisition or sale of real property for a public purpose, as per subsection 3; - legal matters requiring advice of legal counsel, as per subsection 7. The subject matter of the meeting includes the possible acquisition and possible sale and development of certain real estate properties for public purposes, and legal matters involving legal documents and interpretation of the laws of the Commonwealth of Virginia, and possible litigation. The purpose of the meeting is to protect and permit frank and confidential discussion of matters for which public disclosure could harm the financial interests of the City and its taxpayers.
